1. Who We Are

The Memories that Matter™ website is owned and operated by DadiMa Ventures. 

This online store is hosted and powered by Shopify. You purchase directly from us, not from Shopify.

 

2. Use of Our Website

You may browse and use our website for personal, non-commercial purposes.

You agree not to misuse the website, attempt to access restricted areas, or interfere with its operation.

You must be at least 18 years old to place an order.

 

3. Our Products

We make every effort to display our products accurately.

However:

• Colours may vary depending on screen settings.

• We may change or discontinue products without notice.

• Quantities may be limited.

A contract is only formed when we send an order confirmation.

6. Shipping & Delivery

We ship to Germany and selected international destinations.

Delivery times shown at checkout are estimates and not guaranteed.

We are not responsible for delays caused by carriers or events outside our control.

 

Risk Transfer (B2C EU/Germany)

For consumer orders within the EU, the risk of loss or damage passes to you only when you physically receive the goods (or when a person you designate receives them), as required by EU law.

If you choose your own carrier independently of our offered options, risk transfers when we hand the goods to that carrier.

 

7. Returns & Withdrawal Rights

For consumer orders within the EU, your statutory 14-day EU right of withdrawal applies to all eligible consumer purchases.

We do not control these services and are not responsible for their content or behaviour.

10. Shopify’s Role

Our store runs on Shopify’s platform.

Shopify assists in providing technical functionality but is not a party to your purchase contract.

Any transaction, complaint, or issue related to your order is between you and Memories that Matter™ / DadiMa Ventures.

 

11. Liability

Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for:

• Intentional misconduct

• Gross negligence
  

• Product liability under applicable law

For simple negligence, we are liable only for breaches of essential contractual obligations (“cardinal duties”), and only for typical and foreseeable damages.

Otherwise, to the fullest extent permitted by German and EU law, we exclude all further liability.

 

12. Warranty Rights

Your statutory warranty rights under German law (Gewährleistung) apply.

13. Prohibited Use

You agree not to use our website:

• To violate others’ rights

• To introduce malware or harmful code

• To interfere with the website’s functionality

• To collect data unlawfully

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
